Petitioner is an accused in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code, Section 39/40 of M.D.R. Act and also under Section 30(ii) of Coal Mines Act.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. It is alleged that two tons of coal was recovered by the police, which is said to have been illegally mined by the petitioner. It is further submitted that the petitioner has no concern with the said recovered coal and he has been implicated without any factual basis. The petitioner is in judicial custody since 17.04.2017 and therefore, he may be given the privilege of regular bail.
Learned A.P.P. opposes the petitioner’s prayer for bail.
Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Giridih in connection with Giridih(M)P.S. Case no. 127 of 2017 corresponding to G.R. no. 979 of 2017.
