02/20.07.2017 Apprehending his arrest in connection with Latehar P.S. Case No.92 of 2017 corresponding to G.R. No.369 of 2017 instituted under Sections 419/420/34 and 120B of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submitted that the allegation against the petitioner is that he is the grand-father of Abhinav Pandey who was allegedly driving the car bearing registration No.JH-01BJ-0656 which met with an accident in respect of which Latehar P.S. Case No.141 of 2016 was registered for the offence punishable under Section 279/304A of the Indian Penal Code. It is further submitted that though Abhinav Pandey was driving the said car at the time of the said accident but Rahul Kumar claimed that he was driving the car. Consequent upon Rahul Kumar surrendering in court he has been released on bail. It is lastly submitted that save and except that the petitioner is the grand-father of the Abhinav Pandey, there is no any other allegation against him to implicate him in this case. Hence, the petitioner may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner but concedes that save and except that the petitioner is the grand-father of the Abhinav Pandey, there is no any other material to implicate him in this case.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned Chief Judicial Magistrate, Latehar within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Latehar P.S. Case No.92

of 2017 corresponding to G.R. No.369 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
