02/19.07.2017 Apprehending his arrest in connection with Jharia (Alakdiha) P.S. Case No.434 of 2014 corresponding to G.R. No.4310 of 2014 instituted under Sections 147, 148, 149, 341, 323, 307, 120B of the Indian Penal Code and Section 27 of the Arms Act, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Heard learned counsel appearing for the petitioner and learned Addl.P.P. appearing for the State.

Learned counsel appearing for the petitioner submitted that the allegation against the petitioner is that being instigated by the petitioner and co-accused persons and in criminal conspiracy with him, suddenly a murderous assault was made on the informant- Tapan Bauri and one Jhabu Kumar Bauri. There is specific allegation against one Vijay Kalinding of firing a gun shot at Jhabu Kumar Bauri from which he received one gun shot injury on his chest. He further submits that the petitioner was not present at the place of occurrence and some of the witnesses have also stated during the investigation about absence of the petitioner at the place of occurrence but after more than two and a half years of the occurrence police has started searching for the petitioner to arrest him. It is lastly submitted that the petitioner is ready and willing to pay ad interim victim compensation of Rs.10,000/-(Rupees ten thousand) in favour of the victims namely- Tapan Bauri and Jhabu Kumar Bauri. Hence, the petitioners may be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court of learned C.J.M., Dhanbad within four weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.10,000/- (Rupees ten thousand) as ad interim victim compensation for the victims – Tapan Bauri and Jhabu Kumar Bauri and on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Dhanbad in

connection with Jharia (Alakdiha) P.S. Case No.434 of 2014 corresponding to G.R. No.4310 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

In case the petitioner deposits the ad interim victim compensation amount of Rs.10,000/- (Rupees ten thousand), the court below is directed to issue notice to the victims namely- Tapan Bauri and Jhabu Kumar Bauri and on their proper identification, the court below shall release the aforesaid amount in their favour equally.
