The petitioner is an accused in a case registered for the offence punishable under Section 379 IPC, Sections 15(2)/15(4) of Petroleum and Mineral Pipeline Act, 1962, Sections 3/4 of the Explosive Substance Act and Sections 3/4 of the Prevention of Damage to Public Property Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence, as alleged. The petitioner has not been named in the F.I.R. During the investigation, the petitioner was implicated in this case merely on suspicion. It is alleged that on the basis of the confessional statement of the petitioner, one valve and two livers have been recovered from the house of the co-accused Imtiyaz Ansari. It is further submitted that the petitioner has not made any confession before the police, as has been alleged. Nothing has been recovered from the possession of the petitioner. The petitioner is in judicial custody since 16.02.2017 and therefore he may be given the privilege of regular bail.

Learned A.P.P opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of the C.J.M, Jamtara in connection with Jamtara P.S. Case No. 23/2017, corresponding to G.R. No. 170/2017.
