Petitioner is an accused in a case registered for the offences punishable under Sections 25(1-B)a/26 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of two live cartridges from the possession of co-accused Munsi Sao. The names of the petitioner and other co-accused persons were allegedly revealed by the said co-accused Munsi Sao as the persons who fled away from the place of occurrence. The petitioner is in judicial custody since 22.02.2017 and, therefore, he may be given the privilege of regular bail.
Learned A.P.P. has opposed the petitioner's prayer for bail.
Considering the aforesaid facts and circumstances, I am inclined to enlarge the petitioner, named above, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Gumla in connection with S.T. No.18 of 2015 arising out of Gumla P.S. Case No.155 of 2012 corresponding to G.R. No.498 of 2012.
