The petitioner is an accused for the offences punishable under Sections 363/366A/368/370/371/372/373 IPC, Sections 14/15 of Child Labour (Prohibition and Regulation) Act, Sections 23/26 of J.J. Act, Section 20 of Bonded Labour System (Abolition) Act, Section 5 of Immoral Traffic Prevention Act and Sections 16/17 of Protection of Children from Sexual Offence Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence, as alleged in the F.I.R. Though it has been alleged in the written report of the informant that the petitioner along with coaccused Amjad Khan had taken two minor girls of Village-Rampur to Delhi, yet during investigation, no such fact could be established. Coaccused Anita Ekka has already been granted bail by a coordinate Bench of this Court vide order dated 17.02.2017 passed in B.A. No. 114/2016. The petitioner is in judicial custody since 10.12.2014 and therefore he may be given the privilege of regular bail.

Learned A.P.P opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bailbond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Gumla in connection with S.T. No. 28/2015, arising out of AHTU

Chainpur Gumla P.S. Case No. 31/2014 (G.R. No. 1158/2014), subject to the condition that the petitioner shall co-operate in the trial and shall be present as and when required by the Court, failing which the Trial Court is at liberty to pass appropriate order against the petitioner in accordance with law.
