Petitioner has sought extension of time for depositing 40% of the rent from the due date as directed by the order dated 15th May 2017 passed in W.P.(C) No.571/2017. It is submitted on behalf of the petitioner that due to unavoidable reasons the amount could not be deposited in the three weeks' time. Certified copy of the order could be obtained only after the ensuing summer vacation. By that time the three weeks' period had elapsed. Petitioner has, therefore, genuine reason to seek extension of time. He would suffer irreparably, if suitable extension of time is not allowed.
Counsel for the sole respondent/opposite party herein, however, objects to the prayer.
Having considered the submissions of the counsel for the parties and for the reasons stated in the instant petition, time as directed by the order dated 15th May 2017 to deposit 40% of the rent as fixed by the order dated 9th January 2016 passed by the Rent Controller in H.R.C. Case No.59/2015 is extended for a period of further two weeks, however, on payment of cost of Rs.3,000/- to the opposite party during the same time. The cost would also be deposited before the revisional authority along with pre-deposit. Accordingly, the instant petition is disposed of.
