Heard learned counsel for the parties.
The petitioners are an accused for the offence under sections 147, 148, 149, 341, 342, 323, 324, 307, 427, 379, 504, 506 of the Indian Penal Code and read with Section 3/4 of the Prevention of Witch (Daain) Practice Act.
It is alleged that the petitioners and others have assaulted the mother of the informant with sticks. Initially the case was lodged for the offence under Section 307 of the I.P.C. and read with Section 3/4 of the Prevention of Witch (Daain) Practice Act. The police investigated and filed charge-sheet under the several sections of the Indian Penal Code, but not under Section 307 of the I.P.C. and section 3/4 of the Prevention of Witch (Daain) Practice Act. The petitioners are in custody since 14.10.2016.
Learned A.P.P. opposes the prayer for bail.
Regard being had to the facts and circumstances of this case, petitioners named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Ghatshila, in connection with Chakulia, P.S. Case No. 28 of 2016, corresponding to G.R. No. 365 of 2016.
