04/14.06.2016: The petitioner was appointed as a Live-stock Assistant in the Animal Husbandry Department, Government of Jharkhand on 20.7.1966 and after serving the department about 36 years, he superannuated from the said post on 30.7.2002 from Jarmundi Block, District- Dumka.

The petitioner submits that he has been paid all his post retiral benefits but since he was not given any promotion in his entire career he should be given the benefits of ACP/MACP. The petitioner further submits that he has made several representations before the authority concerned but, his representations have not yet been considered nor disposed of.

The counsel for the State submits that the petitioner should file a fresh representation before the Director, Department of Animal Husbandry, Government of Jharkhand, Ranchi, and the same will be disposed of at the earliest.

Regard being had to the prayer, I direct the petitioner to file a representation before respondent No. 3 within a period of two weeks from today annexing all the documents which the petitioner is relying upon. Respondent No. 3 on receipt of the said representation will dispose of the same by passing a reasoned order in accordance with law within a period of six weeks thereafter. If respondent No. 3 comes to a conclusion

that the petitioner is entitled to get the relief, as claimed for, the same will be extended to him and his post retiral benefits will be re-calculated as well as all necessary consequential orders will be passed by him within a period of two weeks, thereafter.

The writ petition stand disposed of, accordingly.
