05/05.01.2016 Seeking a direction upon the respondents for proper enquiry for selection of location for L.P.G. station, the present writ petition has been filed.

At the outset, Mr. Delip Jerath, the learned counsel for the respondent-HPCL raising a preliminary objection submits that the petitioner has been found not eligible and his candidature has been rejected vide communication dated 11.11.2013 however, the said communication has not been challenged by the petitioner.

The learned counsel for the petitioner submits that it is one of the essential conditions mentioned in the advertisement inviting applications for appointment of distributor under Rajiv Gandhi Rural L.P.G. Distributorship that the land provided by the applicant must be connected with a good motorable road however, in the village Sarhu there is no proper road and therefore, only after a proper enquiry the applications for distributorship should have been finalised.

4. In the writ petition, the petitioner has asserted that he is a resident of village Urdhawar. The locations for Rajiv Gandhi Gramin L.P.G. Vitrak have been advertised for Jhargara, Jamua, Sarhu, Supha and Chandarpur village. An applicant is required to provide land in the aforesaid places. Admittedly, the petitioner offered land in the village Urdhawar and not in the advertised locations. The candidature of the petitioner has been rejected and the order of rejection is not under challenge. The plea that village Sarhu is not connected with motorable road cannot be a ground for directing the respondents to conduct an enquiry. The location for RGGLV Distributorship has been decided by the respondentHPCL and the Court would not interfere with such decisions.

5. I find no merit in the writ petition and accordingly, it is
