The matter relates to promotion of Class-IV employees to the posts of Class-III on the quota reserved for promotion. It is the case of the petitioners that the petitioners are working since the year 1987-88 itself, but no promotion has yet been given by the State Government to the Class-IV employees.

An identical matter was disposed of by this Court on 8.8.2016 in WP(S) No.1710 of 2015 (Dalapati Munda & Ors. Vs. The State of Jharkhand & Ors.), wherein it was brought on record that the State of Jharkhand has already framed the Rules as contained in Notification No.1749 dated 27.3.2010, for filling up 15% of Class-III posts falling vacant in a year by promotion from Class-IV posts and 85% through direct recruitment. The promotion quota is to be filled up through limited competitive examination to be held by the Staff Selection Commission, Jharkhand. It also came in the said writ application that for holding the limited competitive examination, a requisition has already been made by letter dated 26^th April, 2016, to the Jharkhand Staff Selection Commission by the State Government.

In view of the aforementioned facts, this writ application is also disposed of in terms of order dated 8.8.2016 passed in WP(S) No.1710 of 2015, directing the respondent authorities to get the advertisement published and complete the selection process at the earliest. It goes without saying that the petitioners, if eligible, for such promotion, may also apply upon publication of the advertisement and take their chance along with other eligible candidates.

This writ application is accordingly, disposed of with the directions as above.
