Allowing the instant application for bringing few judicial orders annexed herewith, in our considered view, would change the complexion of the original writ petition [W.P.(S) No. 1418 of 2008] which has been dismissed vide impugned order dated 30.09.2015 on the ground that the Circular dated 22.02.2006 which is made the basis for filing the fresh writ petition [W.P.(S) No. 1418 of 2008] was never before the Writ Court in the earlier proceeding, that is, writ petition [W.P.(S) No. 359 of 2006] which came to be dismissed and in L.P.A. No. 272 of 2006 the said order was confirmed. The instant application thus, devoid of merits is hereby dismissed .

Being that the fact position of the case in hand, the instant appeal also merits dismissal. The plea which was not accepted in the earlier writ proceeding, has now sought to be pressed again in view of 2006 Circular, which cannot be permitted. The instant Letters Patent Appeal stands dismissed .
