02/08.01.2016 The aforesaid criminal miscellaneous petition has been filed at the instance of the petitioner with a prayer to modify the earlier order of surrender in the court below.
Learned counsel Mr. Deo submitted that while granting bail to this petitioner vide order dated 19.11.2015 in A.B.A. No.3482 of 2015, two weeks time was granted to the petitioner to surrender in the court below but as the petitioner was suffering from some ailment, he failed to surrender in the court below.
I am satisfied with the grounds taken in the criminal miscellaneous petition. Hence, the order dated 19.11.2015 passed in A.B.A. No.3482 of 2015 is modified to the extent that the petitioner is directed to surrender in the court below within two weeks from today.
Accordingly, this criminal miscellaneous petition is, hereby, disposed of.
Let this order be communicated through FAX at the cost of the
petitioner.
