The petitioner has been made accused for the offence under Sections 364, 302, 379 / 34 of the Indian Penal Code, in connection with Torpa P.S. Case No. 17 of 2015 corresponding to G.R. No. 104 of 2015, S.T. No. 34 of 2016.
The case relates to abduction and murder of husband of the informant, whose dead body was found. The FIR was lodged against unknown. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has prayed for bail.
Learned counsel for the State has opposed the prayer for bail and has submitted from the case diary that the witnesses have stated that they had seen the petitioner and other accused persons dragging away the deceased and subsequently, his dead body was found.
In the facts of this case, there being allegation against the petitioner, Anup Guria, to have abducted the deceased for murder, I am not inclined to enlarge him on bail. Accordingly, his prayer for bail is rejected.
