Heard Mr. Mohammad Asghar, learned counsel appearing for the petitioner. No one appeared for the State.

Earlier the prayer for bail of the petitioner was rejected vide order dated 20.08.2015 passed in B.A. No. 6063 of 2015.

It has been submitted by the learned counsel for the petitioner that the prosecutrix has been examined as P.W. 3 wherein she has not disclosed the name of the petitioner, who had committed rape upon her. It has also been submitted that under similar circumstances coaccused , namely, Rupesh Kumar Jha has been granted bail by this Hon'ble Court vide order passed in B.A. No. 4292 of 2016 and that petitioner is in custody 04.05.2015.

Learned A.P.P. appearing for the State has opposed the prayer

for bail of the petitioner.

Regard being had to the evidence which has been given by the prosecutrix of this case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Seraikella in connection with S.T. No. 122 of 2015 arising out of Adityapur (R.I.T.) P.S. Case No. 178 of 2015 (G.R. No. 503 of 2015).
