The petitioner has been made an accused for the offence registered under Sections 120B, 406, 420, 467, 468, 471 and 472 of the Indian Penal Code.
2. Learned counsel for the petitioner has submitted that initially the State police had registered Bariatu (Gonda) P.S. Case No.101 of 2012 under Sections 120B, 406, 420, 467, 468, 471 and 472 of the Indian Penal Code and police submitted the charge-sheet. However, in the meantime by the Notification No.228/ 53/ 2012- AVD II dated 12.07.2015 issued by the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Government of India, the investigation was handed over to the Central Bureau of Investigation. That the Central Bureau of Investigation had investigated in the matter and they have not submitted any charge-sheet against this petitioner, which would be evident from the Annexure – 2 to this bail application, as no material evidence was found against him.
3. Mr. K. P. Deo, learned retainer standing counsel for the Central Bureau of Investigation has, not controverted the above submission.
4. Heard. Regard being had to the facts and circumstances of the case, the petitioner is directed to be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judicial Magistrate (CBI) -cum- S.D.J.M., Ranchi in connection with RC – 16 (S) of 2013 – R arising out of Bariyatu (Gonda) P.S. Case No.101 of 2012.
