The petitioners have been made accused for the offence registered under Sections 18, 20, 22 of N.D.P.S. Act.
Heard Learned counsel for the petitioners and learned counsel for the State.
Learned counsel for the petitioner has submitted that the petitioners have been falsely implicated in this case as they were apprehended while they were seen fleeing away from the place by the police party. It is submitted that the land on which the poppy is alleged to have been cultivated belongs to Patric Tete and Paul Tete. The petitioners have no concern with the said opium plant, cultivated on the said land. It is submitted that the villagers in para nos. 51, 52, and 53 of the case diary have stated that the said land was given on Batai to Mashih soreng and two others, who had cultivated the opium plant on the said land and they have not named the petitioner.
Learned counsel for the State has opposed the prayer for bail.
Regard being had to the facts and circumstances of the case, petitioners are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (Rs Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Gumla in connection with Kamdara P.S. Case No. 08 of 2016 corresponding to G. R. No. 145 of 2016.
