Heard learned counsel appearing for the petitioner and learned A.P.P. appearing for the State.

The petitioner is an accused in the case instituted under Sections 457/380/411 of Indian Penal Code.

Learned counsel appearing for the petitioner submitted that the petitioner is not named in the F.I.R. and his name has been transpired on the confessional statement of the co-accused which has got no evidentiary value. It has further been submitted that the recovery of stolen articles was made not from the possession of the petitioner but from the possession of the co-accused which is apparent from the impugned order.

Learned A.P.P. appearing for the State though has opposed the prayer for bail but has not controverted the said fact.

Having heard learned counsel for the parties and regard being had to the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Seraikella in connection with Chandil P.S. Case No. 55/2016 arising out of G.R. No. 306/2016.
