The petitioner is an accused in a case instituted under Section 395 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the instant FIR has been instituted against unknown persons and as such, this petitioner has falsely been implicated in this case. He submits that one of the co-accused, namely, Sobrati Ansari has been enlarged on bail by this Court in B.A. No.8838 of 2015.
Regard being had to the facts and circumstances of the case and in view of the fact that one of the co-accused has been enlarged on bail. I am inclined to grant bail to the petitioner. Accordingly, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-XIVth, Dhanbad, in connection with Govindpur P.S. Case No.28 of 2015, corresponding to G.R. No.366 of 2015 (S.T. No.327 of 2015) on the condition that the petitioner shall remain present before the court below on each and every date.
