2/ 06.04.2016. Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners have been made accused in connection with Chandwara P.S. Case No.87 of 2014, corresponding to G.R. No. 844 of 2014, S.T. No. 98 of 2015, for the offence under Sections 341, 323, 324, 302 / 34 of the Indian Penal Code.
The case relates to murder of the nephew of the informant. The informant is the eye witness to the occurrence as he was also injured in the occurrence.
In the F.I.R. there is direct allegation against the petitioner Arjun Ravidas to have assaulted the deceased by sharp cutting weapon due to which he subsequently died. There is no allegation of assault upon the deceased by the petitioner Geeta Devi.
In the facts of this case, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner Arjun Ravidas, is hereby rejected.
So far the case of the petitioner Geeta Devi is concerned, I am inclined to release her on bail. Accordingly, the petitioner, Geeta Devi, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1, Koderma, in connection with, Chandwara P.S. Case No.87 of 2014, corresponding to G.R. No. 844 of 2014, S.T. No. 98 of 2015.
