09/19.08.2016: This particular case arises out of a separate complaint case which is not similar with tagged case, being A.B.A. No.485 of 2016. In that view, both the cases are detached.
Heard learned counsel for the parties.
The petitioner is an accused in a case registered under Sections 406 and 420 of the Indian Penal Code.
Counsel for the complainant/Opposite Party No.2 submits that this case relates to violation of some of the conditions of an agreement.
From perusal of the complaint case, counter affidavit filed by the complainant, and the argument advanced, it is clear that there is a dispute in respect of non-compliance of some of the conditions of the agreement. The agreement was in respect of appointment of consignment agent.
In view of nature of allegation levelled, this Court feels that the allegations are primarily civil in nature.
That being the position, the petitioner, above named, is directed to surrender before the court below within six weeks from today and, if he does so, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of like amount, each, to the satisfaction of the learned Judicial Magistrate, 1st Class, Ranchi in connection with Complaint Case No.2149 of 2010, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
