02/22.09.2014 The grievance of the petitioner, who was appointed in the year 1988 as Assistant Teacher on compassionate ground is that he should be granted promotion to Grade-I from the date of his joining as he has acquired necessary Teachers' Training Qualification during the course of his services in the year 2002. The petitioner has relied upon the judgment rendered in the case of Arun Sinha & ors – vs- State of Jharkhand in W.P.(S) no. 638 of 2006 and the judgment passed in Letters Patent Appeal No. 214 of 2008 preferred by the State of Jharkhand against the said judgment. It is submitted that the delay in acquisition of the Teachers' Training Qualification was not on account of his fault.

Learned counsel for the respondent- State is therefore allowed 4 weeks' time to obtain instruction in the matters. The respondent would examine the case of petitioner as to whether he is covered by the judgment rendered in the case of Arun Sinha and others(supra) .
