03/08.01.2015 Referring to counter-affidavit dated 28.11.2013, Mr. Md. Sohail Anwar, the learned Senior counsel appearing for the respondent-Jharkhand Academic Council submits that the grievance made in the writ petition stands redressed.

Mr. P. P. N. Roy, the learned Senior counsel appearing for the petitioner submits that it appears from the letter dated 08.02.2013 that the Secretary of the Governing Body has yet not been appointed and therefore, a suitable direction may be issued

by this court. It is further submitted that huge money of the college has been misappropriated by the respondent no. 6 however, no action so far has been taken in this regard.

In reply, Mr. Md. Sohail Anwar, the learned Senior counsel appearing for the respondent-Jharkhand Academic Council refers to paragraph nos. 7 and 8 of the counter-affidavit and submits that the complaint of the petitioner has already been referred to the Deputy Commissioner. It is stated that Jharkhand Academic Council cannot on its own take action for the alleged financial irregularities and since the matter has been referred to the Deputy Commissioner, the petitioner cannot raise grievance against the respondent-Jharkhand Academic Counsel.

In view of the specific stand taken by the respondent-Jharkhand Academic Council, I am of the opinion that this writ petition has been rendered infructuous. In the writ petition a direction has been sought to respondent no. 1 for taking necessary action in the matter and since the respondent no. 1 has taken a specific stand that no action can be initiated by the respondent no. 1 for the alleged financial irregularities, I am of the opinion that no further direction can be given to the respondent-Jharkhand Academic Council.

In the result, this writ petition is dismissed as infructuous.
