It appears that notices were issued to opposite party No. 2 on earlier occasions, but undelivered registered cover has been received with the report of the postal peon that the opposite party No. 2 has been transferred. The opposite party No. 2 is the Deputy Labour Commissioner, who at that relevant point of time was posted in Hazaribagh.

Since the State is being represented by Shri V. S. Sahay, learned A.P.P., he is also directed to seek instruction on behalf of opposite party No. 2 and file an affidavit in opposition to this quashing petition and for this purpose he is granted two weeks' time.

Learned counsel for the petitioner is directed to serve a copy of the quashing petition along with its annexures to Shri V. S. Sahay by 10.12.2014.

Put up this case after two weeks.

Till the next date of listing, the interim order dated 6.10.2009 granted in connection with Hazaribagh G. Case No. 2 of 2005 (T.R. No. 339 of 2005) shall continue.
