03/ 02.03.2015 The petitioner is an accused in a case registered under Sections 147/148/149/342/323/324/307/379/504 of the Indian Penal Code.
It reveals from the F.I.R. that both the parties fought with each other for taking possession over the land under dispute.
It is submitted that allegation against this petitioner and Sabbir Mian @ Sabbir Ahmad are almost similar and Sabbir Mian @ Sabbir Ahmad has been granted bail vide B.A.No. 11944/2013. The petitioner has sustained injury in the incident and he was under treatment and, therefore, he has been remanded in this case after he stood cured.
Counsel for the State has opposed the prayer.
Admittedly, there is case and counter case and most of the
accused have been granted bail by this Court.
In the circumstances, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Ten thousand) with two sureties of like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Madhupur in connection with Sarath P.S. Case No. 113/2013, corresponding to G.R.No.454/2013.
