The petitioner is an accused in a case registered under Sections 25(1-b)A, 26 and 27 of the Arms Act.
The petitioner was apprehended with his associates while he was moving in a Bolero vehicle, bearing Registration No.JH-01BE-2237. On search, he was found in possession of a pistol loaded with cartridge. Besides the pistol, he was also found in possession of two cartridges. Four mobiles kept in a bag and one 12 Bore loaded country made pistol and one cartridge have also been recovered.
It is submitted that the petitioner has been languishing in jail custody for one year. Recovery of arms and ammunition has been planted by the police.
Counsel for the State has opposed the petitioner's prayer for bail.
Considering the facts and circumstances of the case and period of detention of the petitioner in jail custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount, each, to the satisfaction of learned Judicial Magistrate, Seraikella, in connection with Ichagarh P.S. Case No.10 of 2014, corresponding to G.R. No.302 of 2014.
