The petitioner is an accused in connection with Rail Chandrapura G.R. P.S. Case No. 16 of 2014, corresponding to G.R. No. 117 of 2014, registered for the offence punishable under section 379 of the Indian Penal Code.
It has been submitted by the learned counsel for the petitioner that he petitioner has been falsely implicated in the present case in view of the statement of co-accused Md. Sarfraj Ansari, from whose possession a Samsung Tab was recovered. It has further been submitted that the petitioner is in custody since 4.6.2015.
Learned counsel for the State has opposed the prayer for bail but has not disputed the aforesaid facts.
Regard being had to the facts and circumstances of the case and the period of custody, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate (Railway), Dhanbad, in connection with Rail Chandrapura G.R. P.S. Case No. 16 of 2014, corresponding to G.R. No. 117 of 2014.
