Petitioner has been made accused in connection with Raidih P.S. Case No.51 of 2007, corresponding to G.R. No.566 of 2007, for the offence under Section 302/307/324/225/353/427/120-B/216-A of the Indian Penal Code, Sections 4 / 5 of the Explosive Substance Act, Section 27 of the Arms Act and Section 17 of the CLA Act.
There was encounter between the police party and the members of the extremist group, in which two police personal were killed and two others were injured. Earlier the bail application of the petitioner was rejected on merits by order dated 7.8.2013 in B.A. No.3541 of 2013.
It appears from the impugned order that the name of the petitioner has come in the confessional statement of the co-accused and it has been submitted by the learned counsel for the petitioner that in the similar circumstances, other co-accused has been granted bail by order dated 2.8.2012 in B.A. No.5806 of 2012. Learned counsel accordingly, renewed the prayer for bail.
In the facts and circumstances of the case, I am inclined to release the petitioner on bail. Accordingly, the petitioners Joseph Ekka @ Joseph Oraon is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-I, Gumla, in connection with Raidih P.S. Case No.51 of 2007, corresponding to G.R. No.566 of 2007, S.T. No.238 of 2009(A).
