2/28.4.2015 Both these applications arise out of the same case and as such, these are being disposed of by this common order.
Heard learned counsel for the petitioners and learned counsel for
the State.
The petitioners have been made accused in connection with Ratu P.S case No.143 of 2014 corresponding to G.R No.3916 of 2014, for the offence under Sections 147, 148, 149, 307, 323, 337, 338, 379, 295 and 427 of the Indian Penal Code.
There is omnibus allegation against 100-120 persons and 39 named accused persons, including the petitioners, of committing mischief in the Temple and also to have assaulted and injured several persons. It appears that there is a case and counter case between two groups of persons. There is only omnibus allegation against the petitioners in the F.I.R.
Learned counsel for the petitioners submitted that in the similar circumstance, the other co-accused has been granted bail by order dated 06.4.2015 passed in B.A No.9299 of 2014.
In the facts and circumstances of the case, I am inclined to enlarge the petitioners, Sultan Rai @ Sultan and Ismaiel Ansari @ Islam Ansari , on bail. Accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each, to the satisfaction of Sri Deepak Barnwal, learned Judicial Magistrate, 1st class, Ranchi, or his successor, in connection with Ratu P.S case No.143 of 2014 corresponding to G.R No.3916 of 2014.
