appeared before the Court showing himself as Bachchu Tarafdar and filed his examination-in-chief on oath as a defence witness no. 5 and the applicant no. 2 appeared before the Court who has filed his examination-in-chief on oath as a defence witness no. 4 and they have deposed that the alleged agreement for sale dated 07.07.1992 has been executed by Bachchu Tarafdar @ Prakash Tarafdar. During course of trial, it has come to notice of the Court that Bachchu Tarafdar @ Prakash Tarafdar has already died due to road accident. Vide order dated 01.07.2014, the applicants were granted time to file documents to establish the identity of the person who died in the road accident. Though, one supplementary affidavit has been filed however, inspite of more than 6 months the applicants have not filed any document to establish

the identity of the person who died in the road accident. The applicants have enjoyed the privilege of order dated 01.07.2014 for more 6 months however, they have failed to produce documentary evidence in support of their case.

The learned counsel for the applicants submits that the case has been compromised between the parties.

The learned A.P.P. appearing on behalf of the State opposes the prayer for grant of anticipatory bail. The present proceeding has been initiated at the instance of the Court below.

In view of aforesaid, order dated 01.07.2014 is recalled and this anticipatory bail application is dismissed.

The applicants are directed to surrender before the Trial Court forthwith.

Let a copy of this order be sent through 'FAX' to the concerned Trial Court.
