03/16.01.2015 Heard the learned counsel appearing for the parties and perused the documents on record.
The applicants are apprehending their arrest in Complaint Case No. 124 of 2008 filed under Section 420 of the Indian Penal Code.
In view of the office report, the opposite party no. 2 is deemed to have been validly served. Vide order dated 30.07.2014 provisional bail was granted to the applicants.
The learned A.P.P. does not make any grievance of misuse of the privilege of provisional bail by the applicants. Since the opposite party no. 2 has chosen not to appear in the present proceeding and there is no complaint of misuse of provisional bail by the applicants, the provisional bail granted by this Court vide order dated 30.07.2014 is hereby confirmed and accordingly, the present application stands allowed.
Let a copy of this order be sent to the trial court through FAX on depositing the cost by the applicants.
