Heard Mr. Vijay Kumar Roy, learned counsel for petitioner and Mr. P.K. Appu, learned counsel for the State.

The petitioner apprehends his arrest in connection with Nimiyaghat P.S. Case No. 56 of 2013, corresponding to G.R. No. 1446 of 2013, registered for the offence punishable under Sections 498-A of the Indian Penal Code and 3 & 4 of the Dowry Prohibition Act.

It has been submitted by the learned counsel for the petitioner that the petitioner is the mother-in-law of the informant and the allegation leveled in the complaint petition is general and omnibus in nature. It has further been submitted that, in fact, the husband of the informant was all along ready and willing to keep the informant with full dignity, honour and affection and for that purpose he had gone to his Sasural to bring his wife, but he was arrested in his Sasural itself by the police. It has further been submitted that in course of hearing of the bail application of the husband of the informant an offer of keeping the informant was flatly refused by the informant.

Learned A.P.P. has opposed the prayer for anticipatory bail.

Considering the fact that the petitioner is the mother-in-law and the allegations are general and omnibus in nature, I am inclined to allow this anticipatory bail application. Accordingly, the petitioner, above named, is directed to surrender in the Court below within a period of three weeks from today and on her so surrendering she shall be released on bail on furnishing bail bond of Rs.10000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of Shri Shwaymbhu, learned Judicial Magistrate, 1st Class, Giriidh, in connection with Nimiyaghat P.S. Case No. 56 of 2013, corresponding to G.R. No. 1446 of 2013, subject to the terms and conditions as enumerated under section 438(2) of the Code of Criminal Procedure.
