Heard Mr. Nilesh Kumar, learned counsel, appearing for the petitioner and Mr. Shekhar Sinha, learned A.P.P. for the State assisted by Mr. Bhola Nath Rajak, learned counsel for the opposite party No. 2.

Petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Complaint Case No. 1553 of 2014 registered for the offences punishable u/s 498A/323/34 of the Indian Penal Code.

It has been submitted by the learned counsel for the petitioner that the allegation against the petitioner, who is the husband of the victim (sister of the complainant) in the complaint is general and omnibus in nature and that the parents-in-law have already been granted anticipatory bail by this Court in A.B.A. No. 2334 of 2015.

Learned counsel appearing for the opposite party No. 2 has opposed the prayer for anticipatory bail of the petitioner and has submitted that the opposite party No. 2 has filed an application before this Court u/s 482 Cr.P.C. for cancellation of anticipatory bail granted to the parents-in-law in A.B.A. No. 2334 of 2015 and the petitioner being the husband is the main accused.

Regard being had to the fact that the allegation levelled in the complaint petition seems to be general and omnibus in nature, I am inclined to allow this application. Accordingly, the petitioner, named above, is directed to surrender in the court below within three weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Hazaribagh in connection with Complaint Case No. 1553 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
