Suman Devi and Ors. Vs The State Of Jharkhand

The petitioners have been prosecuted for committing murder of Kavita Kumari, daughter of the informant. Kavita died at Dhanbad. Without giving information to the police, the accused persons wanted to cremate the deceased-Kavita, but in the mean time matter was informed to the police and this case has been registered.

It is submitted that Petitioner No.1 is married sister-inlaw, Petitioner No.2 is mother-in-law and Petitioner No.3 is father-in-law. They were living separately and they did not know, how Kavita died, while she was staying with her husband at Dhanbad.

Counsel for the State has opposed the petitioners' prayer for anticipatory bail and submitted that processes have already been executed against accused persons.

Considering all these aspects of the matter, I do not feel inclined to give benefit of Section 438 Cr.P.C. to the petitioners, above named, in connection with Dhanbad (Saraidhela) P.S. Case No.741 of 2013, corresponding to G.R. No.3098 of 2013.

However, the petitioners shall be at liberty to surrender before the court below within two weeks from today and pray for regular bail, which may be considered without being prejudiced to the order of this Court.
