The petitioner apprehends his arrest in connection with Nawadih P.S. Case No. 109 of 2013, corresponding to G.R. No. 1118 of 2013, registered for the offence punishable under section 413, 414, 120B/34 of the Indian Penal Code and section 33 of the Indian forest Act.
It has been submitted by the learned counsel for the petitioner that on the basis of secret information the the petitioner has been named in the first information report and in course of investigation none of the witnesses has come forward to suggest that the petitioner has illegally mined the coal from protected forest area.
Learned A.P.P. has opposed the prayer for anticipatory bail and has submitted that the petitioner has criminal antecedent and three cases have been instituted in the Nawadih police station against the petitioner, which is evident from the case diary.
Regard being had to the criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail is hereby rejected.
