5/01.05.2015: This application has been filed for restoration of WPC No. 2635 of 2010 which was dismissed on 06.06.2011 for non compliance of order dated 20.5.2011.
It is submitted that by the said order, petitioner was directed to file substitution petition as Respondent No. 2 had died during the pendency of the aforesaid writ application.. It is submitted that the petitioner has filed substitution petition but after expiry of peremptory period. It is submitted that delay has been caused due to communication gap.
In view of the aforesaid facts and circumstance, I allow this application and restore WPC No. 2635 of 2010 to its original file.
