Heard learned counsel for the appellant (respondent no. 3 before the writ Court) at length and with the assistance rendered by him perused the impugned judgment delivered by the writ Court and other relevant documents attached with the memo of the appeal.
In our considered view, it is not a case of showing any indulgence with the impugned order of learned writ Court finding no perversity in it on any count, for a very simple reason that the matter stands remanded to the Assistant Labour Commissioner, Jamshedpur for arriving at a just conclusion of the case after affording opportunity to the respondent-writ petitioner and that the next date fixed before the Assistant Labour Commissioner, Jamshedpur is 15.12.2014 on which date both these parties have to put their appearance.
Viewed thus, we without disturbing the impugned order of the writ Court direct Assistant Labour Commissioner, Jamshedpur to wrap up the proceedings arising out of B.S. Case No. 06 of 2001 expeditiously, preferably within one month only from the next date i.e. 15.12.2014.
Disposed of as such.
