This contempt petition has been filed for initiating contempt proceedings against the opposite parties for willfully not complying the direction issued in W.P.(S) No. 4162 of 2010 by the learned Single Judge on 16.09.2010 allowing the writ petition.

The writ petition W.P.(S) No.4162 of 2010 was allowed with the following directions and observations:-

“5. Considering the above facts and circumstances, this application is disposed of with a direction to the Deputy Commissioner-cum-Returning Officer, Palamau (Respondent No.2) and the Superintendent of Police, Palamau (Respondent No.3) to consider the petitioner’s claim for payment of compensation as demanded through his representation (Annexure-8) and reminder thereto (Annexure-8/A) and take an appropriate decision on the same and communicate such decision to the petitioner effectively within two months from the date of this order. In the event the petitioner is found entitled, the respondent authorities shall ensure that appropriate orders/instructions are issued so as to enable payment of the assessed compensation amount to the petitioner within one month from the date of decision taken on the petitioner’s representation.”

The petitioner is represented by the learned counsel Mr. A.K.Amar and the Opposite Party- State of Jharkhand is represented by Mr. Rishikesh Giri, J.C. to G.P.-II.

The Opposite Parties have filed show cause stating that in furtherance of the order passed by the Court, reasoned order has been passed and the representation of the petitioner has been disallowed on 14.03.2014 and the same was communicated to the petitioner vide Memo No.197/L.S dated 14.03.2014.

Since the order passed in the writ petition has been complied with, the contempt proceeding is dropped. If the petitioner is still aggrieved by the order dated 14.03.2014, he is at liberty to challenge the same in accordance with law.
