Alleging willful disobedience of the order passed in W.P.(S) No.5253 of 2012 dated 21.09.2012, the petitioner has filed this contempt petition.
In the writ petition the respondent No.2 was directed to take a decision and pay monetary benefits found due to the petitioner.
The petitioner is represented by the learned counsel Mr. Vishal Kumar and the opposite party No.2 is represented by the learned counsel Mr. Bhavesh Kumar.
The Opposite Party No.2 has filed the show cause dated 21.11.2013. In the show cause it is stated that as per the report of the Accounts Officer, a total sum of Rs.6,78,317/- is legally payable to the petitioner under different heads. It is further stated that an amount of Rs.1,00,000/- has been sanctioned to the petitioner by the authority immediately. In the show cause the opposite party No.2 seeks permission of this Court to pay the outstanding amount in installment of Rs.50,000/- per month in view of the financial crunch of MADA. The learned counsel appearing for the opposite party No.2 has also submitted that in similar contempt cases (Cont. Case (C) No.577 of 2013 and Cont. Case (Civil) No. 1031 of 2013), the Court hearing the contempt petition, has permitted MADA to pay the retiral dues to the employees in installments.
Since the order passed in W.P.(S) No.5253 of 2012 has been substantially complied with, the contempt proceeding is dropped. In so far as the payment of remaining amount, the opposite party No.2 is permitted to make the payment in installment as stated in the show cause.
