5/1.11.2014 Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has been made accused for the offence under Section 394 of the Indian Penal Code, in connection with Namkum P.S. Case No.299 of 2013, corresponding to G.R. No.5042 of 2013.
The case relates to robbery and the earlier bail application of this petitioner was rejected on merits by order dated 25.2.2014 in B.A. No.294 of 2014.
Learned counsel for the petitioner has renewed the prayer for bail submitting that the petitioner is in custody since 16.9.2013.
Taking into consideration the period of custody of the petitioner, I am inclined to release the petitioner on bail. Accordingly, the petitioner Md. Nausad Sah @ Paklu is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of Smt. Sweta Kumari, learned Judicial Magistrate, Ranchi, or her successor, in connection with Namkum P.S. Case No.299 of 2013, corresponding to G.R. No.5042 of 2013.
