The petitioner has been made accused in connection with Sadar Chatra P.S. Case No. 157 of 2013 corresponding to G.R Case No. 759 of 2013, for the offence under Sections 409/ 34 of the Indian Penal Code.
The petitioner has been made accused along-with the then District Welfare officer, in whose office the petitioner was working as Nazir . It is alleged that the District Welfare Officer had given scholarship to one student who was not found to be a genuine student and accordingly, a separate case was instituted for the said offence. During the enquiry, similar sixteen cases were also found, in which, the scholarships were granted without following the relevant rules and accordingly, the then District Welfare Officer and other officials, including the petitioner who was working as Nazir , have been made accused.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case and has accordingly, prayed for bail.
Learned counsel for the State has opposed the prayer for bail and has pointed out from the case diary that during the enquiry about grant of scholarships, it was found that there were sixteen further cases, in which, the scholarships were granted without following the relevant rules. However, it is admitted that the amount involved in those sixteen cases are not mentioned in the case diary.
In the facts and circumstances of the case, I am inclined to enlarge the petitioner, Ritan Ram on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Sadar Chatra P.S. Case No. 157 of 2013 corresponding to G.R Case No. 759 of 2013.
