Heard learned counsel for the petitioner and learned A.P.P. for the
State.
The petitioner has been made accused in connection with Balumath P. S. Case no. 44/2011, corresponding to G. R. Case no. 336/2011, S. T. No. 150 of 2011, registered under Sections 395 of Indian Penal Code.
According to the petitioner, he has remained in custody since 16th July, 2011 and the charge has been framed on 21st January, 2012. The petitioner has remained in custody for more than 2 and 1/2 years by now.
Learned counsel for the State, however, opposes the prayer for bail and submits that from the possession of the accused certain ornaments said to have been recovered and he has also criminal antecedent.
Having regard to the facts and circumstances of the case and in view of the fact the petitioner has remained in custody since July, 2012 , let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Principal Sessions Judge, Latehar in connection with Balumath P. S. Case No. 44 of 2011, corresponding to G.R. No. 336 of 2011 now as S.T. No. 150 of 2011, subject to the condition that the petitioner shall attend the trial court on the respective dates fixed by the trial court.
