02/01.03.2014 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
Petitioner has been made an accused in connection with Barwadih P.S. Case No. 27 of 2012 corresponding to G. R. No. 176 of 2012 for the offence under Sections 3, 4 and 5 of the Explosive Substance Act and Section 17 of the Criminal Law Amendment Act.
It is submitted by learned counsel for the petitioner that on the statement of one Sanjay Prasad, the petitioner has been made accused along with 9 others named persons and 40-50 unknown persons for having alleged to have planted land mines while constructing the road. It is submitted that the said Sanjay Prasad has already been granted bail in B. A. No. 5116 of 2012 vide order dated 18.12.2012 by this Court. The petitioner is in custody since 27.02.2013.
Learned counsel for the State has opposed the prayer for bail of the petitioner.
In the facts and circumstances of the case, since the person on whose statements, the petitioner has been implicated in the instant P.S. Case, has already been enlarged on bail and the petitioner is in custody since one year i.e. 27.02.2013, petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Latehar in connection with Barwadih P.S. Case No. 27 of 2012 corresponding to G. R. No. 176 of 2012.
