Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offences under Sections 395 and 412 of the Indian Penal Code, in connection with S.T. No. 338 of 2010, arising out of Hirodih P.S. Case No. 41 of 2006 corresponding to G.R. No. 1572 of 2006.
The case relates to dacoity and in view of the fact that the petitioner was identified in Test Identification Parade, bail applications of this petitioner were earlier rejected twice on merits.
Learned counsel for the petitioner has renewed the prayer for bail submitting that the petitioner is in custody since 28.7.2009 itself.
Taking into consideration the period of custody of the petitioner, I am inclined to release the petitioner, Hiralal Mahto, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Giridih, in connection with S.T. No. 338 of 2010, arising out of Hirodih P.S. Case No. 41 of 2006 corresponding to G.R. No. 1572 of 2006.
