The petitioner is an accused in a case registered as Chakradharpur P.S. Case No. 1 of 2014 (G.R. No. 2/2014), under Sections 376, 306 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that from the allegations made in the FIR itself, it would appear that the petitioner and the victim was having love affairs and the victim had willingly stayed in a hotel with the petitioner where the petitioner is said to have committed rape upon her, but the circumstances, appearing in the case would go to show that she must have had sex with her consent and, thereby, the petitioner cannot be said to have committed the offence under Section 376 IPC.

Regard being had to the facts and circumstances, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Porahat at Chaibasa, in connection with Chakradharpur P.S. Case No. 1 of 2014 (G.R. No. 2/2014).
