2/ 18.02.2014 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.

The petitioner has been made accused for the offences under Sections 498-A, 307, 304-B, 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, in connection with Gola P.S. Case No. 19 of 2013 corresponding to G.R. No. 1121 of 2013, S.T. No. 435 of 2013.

The petitioner is the husband of the deceased and there is allegation against the petitioner to have subjected the deceased to cruelty and torture for demand of dowry and to have committed her dowry death by burning.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and this is a case of accidental death of the deceased, in which, the petitioner was also badly injured in saving her.

The discharge slip of the petitioner has been brought on record issued by the RIMS, Ranchi, which shows that the petitioner had also sustained 40-45% of burn injures.

In the facts of this case, I am inclined to enlarge the petitioner, Kanchan Mahto, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned Addl. Sessions Judge-IV, Hazaribag, in connection with S.T. No. 435 of 2013, arising out of Gola P.S. Case No. 19 of 2013 corresponding to G.R. No. 1121 of 2013.
