3/ 12.02.2014 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution.
The petitioner has been made accused for the offences under Sections 467, 468, 471, 420, 120-B, 414 of the Indian Penal Code, Section 17 of the C.L.A. Act and Sections 13 and 10 of the UAP Act, in connection with Chakradharpur P.S. Case No. 104 of 2013 corresponding to G.R. No. 216 of 2013.
The petitioner was apprehended along with other co-accused persons on 3.6.2013 on the information to the police that some extremists had gone to purchase cane bombs. From possession of petitioner, cash memo of the articles purchased, as also some materials for preparation of cane bombs were recovered. It appears from the FIR that no explosive material was recovered from possession of the petitioner. The apprehended persons also accepted their involvement in extremist activities.
In the facts of this case, I am inclined to enlarge the petitioner, Hanuk Kandir, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned SubDivisional Judicial Magistrate, Porahat at Chaibasa, in connection with Chakradharpur P.S. Case No. 104 of 2013 corresponding to G.R. No. 216 of 2013.
