03/01.04.2013. Anticipatory bail application filed by Binod Pathak is moved by Sri Prabhash Chandra Sinha, learned counsel for the petitioner and opposed by Ms. Niki Sinha, Addl. P.P. for the State.

This is a case under Sections 387, 504/34 of the I.P.C. It is alleged that the petitioner has asked the Munshi of informant brick kiln for paying Rs. 2,00,000/- as levy, otherwise Munshi and owner of the brick kiln will be killed by the party members. There is nothing in the F.I.R. to show that petitioner had used any force armed with weapon. Antecedent report, received by Addl. P.P., shows that petitioner has no criminal antecedent.

Under the said circumstance, I allow this application and direct the petitioner, named above, to surrender in the court below by 08.04.2013 If petitioner surrenders by that time, the court below is directed to enlarge the petitioner, named above, on bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Chatra in connection with Gidhour P.S. Case No.07 of 2009 , corresponding to G.R.No.406 of 2009, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
