8/ 3.9.12. Having heard learned counsel appearing for the petitioner and learned counsel appearing for the complainant, I do not find any illegality with the order dated 5.4.2010 under which cognizance of the offence has been taken under Sections 406 and 420 of the Indian Penal Code. Accordingly, this application stands dismissed.
Notwithstanding the fact that this application got dismissed, the petitioner would be at liberty to take all the pleas which have been taken in this application at an appropriate stage, i.e. at the time of discharge.
