2/ 01.09.2012 Heard learned counsel appearing for the petitioner and learned A.P.P. appearing for the State.
The petitioner is an accused in a case instituted under Sections 414/34 of Indian Penal Code.
Learned counsel appearing for the petitioner submits that according to the case of the prosecution, one motorcycle said to be stolen was recovered from the possession of the petitioner, but admittedly no report was there with respect to theft of that motorcycle and in that event, the petitioner cannot be said to have committed any offence under Section 414 of Indian Penal Code.
Regard being had to the facts and circumstances of the case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribagh in connection with Hazaribagh (Sadar) P.S. Case No. 173 of 2012 arising out of G.R. No. 705 of 2012.
